Key findings
- 15 of 15 casinos carry at least one clause from the controlled list in their binding terms – 44 flagged clauses in total: 0 critical, 12 serious, 32 caution. No critical clause (confiscation at discretion, retroactive cancellation of winnings, no withdrawal route) was found at any of the 15.
- The most common clause is “English-only binding version for a non-English site” – 13 of 15 casinos (888casino, BC.Game, BitStarz, Gamdom, LeoVegas, mBit Casino, Mirax Casino, Mr Green, Rizk, Roobet, Shuffle, Wild.io, Winz.io). Next: “Dormant-account fee” 10 of 15, “Withdrawal only to the deposit method” 8 of 15.
- 8 of 15 casinos carry at least one serious clause (888casino, BitStarz, Gamdom, Guts, mBit Casino, Rizk, Wild.io, Winz.io): “Bonus-abuse definition covers normal play” at 6, “Terms can be changed unilaterally without notice” at 6. A serious clause costs 25 of the 70 points of the terms criterion; a caution clause 10.
- 5 of the 11 clause types in the taxonomy were found at none of the 15 casinos: “Confiscation of verified balances at operator discretion”, “No withdrawal route for verified accounts”, “Retroactive cancellation of winnings without a breach”, “KYC demanded only after a win without a published trigger”, “Max withdrawal from winnings below 5,000 USD per month”.
- 13 of 15 casinos print a version number or a “last updated” date on their terms; BC.Game, Roobet do not. Undated terms make it harder to show which version applied when.
- Beyond the taxonomy, the full-text reviews recorded 158 non-scoring observations across the 15 casinos – most often on confiscation / forfeiture (24), operator discretion (20), fraud, aml and abuse definitions (17). They are counted here and shown on each profile; they never move a score.
- Evidence: 44 of 44 flags are verified against the binding document itself, 32 rest on the terms alone and the others on the terms plus a bonus-terms or help page; 43 of 44 rows carry the clause text as quoted in our record.
What a flag means – and what it does not
A flag is a clause we found in the binding terms that matches one of 11 definitions fixed in Methodology v1.6. The list is closed: a researcher cannot add a new type of flag for one casino, and the severity of each type is fixed in advance – caution, serious or critical. Each clause is judged in its full surrounding context, never as an isolated quote, and only after the whole document has been read. A flag is therefore a documented fact about the wording of the terms on the date shown. It is not an accusation, not a report of an incident, and not a statement about how the casino behaves towards players – those questions belong to the reputation section of each profile, which is kept separate from the terms review.
Flags are the only part of the terms review that touches the Smarter Score: a caution clause costs 10 of the 70 points of the terms criterion, a serious clause 25, and a critical clause sets the criterion to zero and caps the whole score at 59. Anything else a reviewer noticed is recorded as a non-scoring observation; 158 of those exist for the 15 casinos here and they are counted in the second table.
The 11 clause types in plain words
- English-only binding version for a non-English site (caution · −10 points in the Terms & Fairness criterion · found at 13 of 15) – The site is offered in other languages, but only the English version of the terms is legally binding. It does not mean the translations are wrong; it means a difference between versions is resolved in favour of the English text.
- Dormant-account fee (caution · −10 points in the Terms & Fairness criterion · found at 10 of 15) – The terms allow the casino to deduct a fee from an account that has not been used for a stated period. It does not mean a fee was charged; the quote shows when the fee may start and, where the terms say so, how much it is.
- Withdrawal only to the deposit method (caution · −10 points in the Terms & Fairness criterion · found at 8 of 15) – The terms require withdrawals to go back to the payment method used for the deposit; an alternative is foreseen only where that is not possible. It is a common anti-money-laundering rule and is recorded because it limits the player’s choice of method, not as a finding about payouts.
- Bonus-abuse definition covers normal play (serious · −25 points in the Terms & Fairness criterion · found at 6 of 15) – The definition of bonus abuse is wide enough to cover ordinary play, so winnings can be voided for behaviour a player would not recognise as abuse. It does not mean the casino applies the clause that way; it records the reach of the wording.
- Terms can be changed unilaterally without notice (serious · −25 points in the Terms & Fairness criterion · found at 6 of 15) – The terms let the casino change them without committing to prior notice to the player. It does not mean the terms were changed; it records the absence of a notice commitment in the wording, read in full context.
- Inactivity closure in under 12 months (caution · −10 points in the Terms & Fairness criterion · found at 1 of 15) – The terms allow the casino to close an account after less than twelve months without login. It does not say what happens to a balance unless the quoted clause does; it records the closure condition only.
- Confiscation of verified balances at operator discretion (critical · criterion set to 0 and the Smarter Score capped at 59 · found at 0 of 15) – The terms allow the casino to confiscate verified balances at its own discretion. It records the wording of the clause, read in full context, not an observed confiscation.
- No withdrawal route for verified accounts (critical · criterion set to 0 and the Smarter Score capped at 59 · found at 0 of 15) – A verified account has no documented way to withdraw. It records what the documents do not provide, not a payout incident.
- Retroactive cancellation of winnings without a breach (critical · criterion set to 0 and the Smarter Score capped at 59 · found at 0 of 15) – The terms allow winnings to be cancelled after the fact without a breach by the player. It records the wording of the clause, not an observed cancellation.
- KYC demanded only after a win without a published trigger (serious · −25 points in the Terms & Fairness criterion · found at 0 of 15) – Identity verification is demanded only after a win, with no published trigger such as an event or an amount. It records the absence of a published trigger, not how verification is handled in practice.
- Max withdrawal from winnings below 5,000 USD per month (serious · −25 points in the Terms & Fairness criterion · found at 0 of 15) – The terms cap withdrawals from winnings below 5,000 USD per month. It records the published cap only; limits inside an account or per VIP level are not read here.

How we checked
For each casino we read the complete binding terms – the general terms, the bonus terms and, where the terms point to one, the withdrawal or promotion policy – and compared every clause with the 11 definitions of the controlled taxonomy in Methodology v1.6. A clause is flagged only when it matches a definition in its full context; the clause reference and, where the record holds one, the wording are stored with the source document, the evidence level and the date read. The severity is fixed per type, not chosen per casino. Everything else a reviewer noted is recorded as a non-scoring observation. The rows, the two summary tables and every count in the text are computed from the same records that generate the profiles; nothing here is typed by hand, and no commercial data is read.
What this dataset does not show
- A flag describes wording, not behaviour. Whether a casino applies a clause, and how, is a different question – see the reputation section of each profile.
- The taxonomy is deliberately short. A clause that is unusual but matches none of the 11 definitions appears only as a non-scoring observation and is not listed here by text.
- Terms change. Each row carries the date we read the document; a later edition is not reflected until the next re-check, which the profile logs.
- Quotes are shown as recorded at the time of reading, with the clause number the document used then. Where the record holds only the reference, the full context is on the profile.
- Only casinos with a published research profile are included.
Questions
What is a “flag” in a casino’s terms and conditions?
A clause in the binding terms that matches one of 11 fixed definitions in our methodology – for example a dormant-account fee or a right to change the terms without notice. The severity is fixed per type. A flag records what the terms allow on the date we read them; it is not a report of something that happened.
Which clauses appear most often?
“English-only binding version for a non-English site” at 13 of 15 casinos, then “Dormant-account fee” at 10 and “Withdrawal only to the deposit method” at 8. 5 of the 11 clause types were found at none of the 15.
Does a flagged clause change the Smarter Score?
Yes, by a fixed amount: a caution clause costs 10 of the 70 points of the terms criterion, a serious clause 25, and a critical clause sets the criterion to zero and caps the whole score at 59. Non-scoring observations do not change the score at all.
